Terms of Service

These Terms govern access to and use of the askghost service ("Service") provided by askghost ("we", "us"). By creating an account or sending messages through the Service, you ("Customer") agree to these Terms.

1. Account

You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account.

2. Acceptable use

Your use of the Service must comply with the Acceptable Use Policy, which is part of these Terms. Violations may result in suspension or termination.

3. Sender obligations

• You may only send messages to recipients who have given prior opt-in consent. Cold outreach and purchased lists are prohibited.
• You must honor unsubscribes within 24 hours and may not bypass our suppression list.
• You must keep complaint and bounce rates below the thresholds defined by our upstream provider (currently AWS SES: complaint < 0.1%, bounce < 5%).

4. Fees and billing

Paid plans are billed in USD by Polar (our Merchant of Record). Polar handles tax collection and remittance for your jurisdiction. Plans include monthly send volume, and we do not bill for going over it. To send more, you buy a send pack separately; the pack balance tops up your account and does not reset each month. How refunds work is described in our Refund Policy.

5. Service availability

We provide the Service on a commercially reasonable best-effort basis. We do not commit to a formal SLA during the beta.

6. Termination

Either party may terminate at any time. You can cancel from the billing settings screen in the app, and undo the cancellation from the same screen. If you cancel, you keep paid features until the end of the current billing period. Cancellation does not delete send pack credits you already purchased; they are frozen and become usable again if you resubscribe. Upon termination, you may export your data within 30 days; thereafter we may delete it.

If a payment fails Polar, our Merchant of Record, emails you. We do not send that email; the billing settings screen shows a notice and new sends are paused until payment succeeds. Sending resumes as soon as it does.

7. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the prior twelve months.

8. Changes

We may update these Terms; material changes will be communicated by email at least 14 days in advance.
